The Higher Education Opportunity Act
The Higher Education Opportunity Act, enacted into law in August of 2008, incorporated new provisions into Title I, Section 133 of the Higher Education Act to ensure that students have timely access to information about course materials at schools that receive federal financial assistance. These provisions set forth the responsibilities of the publishers and the schools, which are effective July 1, 2010. While the Company recommends that the User reviews the school's requirements with the User's legal advisor, as a reminder the following is a summary of the school's responsibility for textbook disclosure:

  • To the maximum extent practicable, a school must include on its 'Internet' course schedule for required and recommended textbooks and supplemental material all of the following:
    • The International Standard Book Number (ISBN) and retail price
    • If the ISBN is not available, the author, title, publisher, and copyright date
    • If such disclosure is not practicable, the designation "To Be Determined"
  • If applicable, the school must include on its 'Written' course schedule a reference that the textbook information is available on its 'Internet' course schedule and provide the internet address for that schedule.
